Frequently Asked Questions
Clear, practical answers about UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021), free zone jurisdictional boundaries, sprint mechanics, and enterprise vendor requirements.
Jurisdiction, Free Zones & Statutory Scope
Understanding which regulatory frameworks apply to your commercial license.
We are incorporated in DMCC / DAFZA / Shams / RAKEZ. Does the UAE Mainland PDPL apply to us?
Yes, absolutely. Federal Decree-Law No. 45 of 2021 applies to all entities established in the UAE Mainland as well as all commercial, non-financial free zones across the seven Emirates (including DMCC, DAFZA, JAFZA, Dubai Silicon Oasis, Shams, RAKEZ, and others).
The only statutory exemptions are entities operating within financial free zones that enforce their own autonomous data protection regimes—specifically the DIFC (governed by DIFC Data Protection Law No. 5 of 2020) and the ADGM (governed by ADGM Data Protection Regulations 2021). If your commercial license is not in DIFC or ADGM, you fall squarely under the jurisdiction of the UAE Data Office and Decree-Law 45/2021.
Does our B2B company need to comply if we only process corporate client data?
Yes. This is one of the most common legal misconceptions among tech and professional services startups. Personal data is defined under Article 1 as any data relating to an identified or identifiable natural person.
In a B2B context, you continuously ingest personal data: corporate email addresses containing employee names, business phone numbers, CRM contact notes, billing contacts, and employee login credentials. Furthermore, if you offer SaaS software where your client’s end-users log in, you act as a Data Processor under Article 8, which imposes strict statutory security and data segregation duties.
We already comply with European GDPR. Are we automatically compliant with UAE PDPL?
No, not automatically. While the UAE PDPL shares architectural similarities with the EU GDPR (such as the concept of Controllers, Processors, and RoPAs), there are vital statutory divergence points:
- Bilingual Transparency: Public consumer disclosures and consent funnels must be accessible in Modern Standard Arabic under UAE consumer protection standards.
- Consent Thresholds: The UAE law places a heavier primary reliance on explicit, unbundled consent (Article 6) compared to the broader "legitimate interests" ground frequently used in Europe.
- Local Regulatory Reporting: Incident notifications, breach filings, and DPO appointments report directly to the UAE Data Office, not European data protection authorities.
- Cross-Border Cloud Mechanisms: Transfers outside the UAE must align with UAE Data Office adequacy lists and approved bilateral transfer safeguards.
Are there size or revenue exemptions for early-stage startups?
Decree-Law 45/2021 does not provide a blanket exemption based on company headcount or annual turnover. If your company processes personal data of individuals located within the UAE, the statutory obligations (consent, security, incident response, and breach notification) apply immediately.
However, certain operational burdens—such as the mandatory appointment of a dedicated Data Protection Officer (DPO) and the execution of high-risk Data Protection Impact Assessments (DPIAs)—are triggered by the sensitivity and volume of data processing rather than raw revenue. Our Rapid Baseline Sprint is specifically tailored to give early-stage teams full compliance without unnecessary administrative overhead.
Sprints, Delivery Mechanics & Pricing
How our fixed-fee implementations unfold without hourly billing surprises.
How does a 14-day or 30-day compliance sprint actually work?
Our sprints are engineered around a fixed, 4-step cadence:
- Kickoff (Days 1–3): You complete our structured technical discovery questionnaire and participate in a 45-minute architectural review with our lead privacy engineer.
- Drafting & Mapping (Days 4–10): We build your Article 7/8 RoPA register, draft custom bilingual website disclosures, and write your vendor DPAs.
- Technical Review (Days 11–13): We review implementation checkpoints (cookie banner logic, opt-in checkout copy, and cloud server configurations) with your product or ops lead.
- Handover (Day 14 or Day 30): We deliver your editable compliance binder, conduct staff awareness training, and issue your formal Certificate of Implementation.
How much time will our internal team need to commit during the sprint?
Typically between 3 to 4 total hours. We know that founders, CTOs, and operations leaders do not have time to sit in endless workshops.
Our intake is designed to extract technical information efficiently via an asynchronous inventory questionnaire. Your only live commitments are a 45-minute technical discovery kickoff call and a 45-minute deliverable handover and walkthrough session at the conclusion of the sprint. We handle all the heavy drafting, legal cross-referencing, and schema construction.
Are your fees really 100% fixed, or will there be out-of-scope surcharges?
Every sprint package has an exact, all-inclusive price, There are zero hourly billing clocks, zero administrative surcharges, and zero additional fees for standard bilingual Modern Standard Arabic deliverables. The price quoted on your engagement agreement is the exact invoice total.
How does your 60-Day "Audit-Ready Guarantee" work?
If an enterprise client, Tier-1 banking partner, or government entity audits your privacy posture within 60 days of sprint handover and challenges any artifact engineered by FyrahPrivacy (such as your Article 7/8 RoPA, vendor DPAs, or policy disclosures), our senior privacy architects will personally step in, review the auditor's specific objections, and revise the documentation at zero additional charge until procurement clearance is achieved.
Cloud Hosting, Vendor Risk & Architecture
Handling international databases, SaaS platforms, and enterprise security checks.
Our database is on AWS US-East or Google Cloud EU. Does the law force us to migrate to UAE servers?
Not in the vast majority of commercial cases. Articles 22 and 23 of Decree-Law 45/2021 govern international personal data transfers. While data localization is strictly mandated for certain state-classified, defense, or specialized health sectors, commercial SMEs can legally transfer and store data abroad provided that:
- The destination territory has an adequate level of data protection recognized by the UAE Data Office, OR;
- The controller executes approved standard contractual safeguards (such as custom Data Processing Addendums with Standard Contractual Clauses) guaranteeing security, encryption, and data subject rights.
During our Enterprise Shield Sprint, we conduct a Transfer Impact Assessment (TIA) to legally validate your existing cloud footprint without requiring an expensive, disruptive database migration.
What is an Article 8 Data Processing Agreement (DPA), and why do our enterprise clients demand one?
Under Article 8, whenever a Data Controller (your client) shares personal information with an external service provider or technology vendor (your business), the relationship must be governed by a legally binding contract.
This DPA legally obligates the vendor to only process data under documented instructions, enforce enterprise-grade encryption, assist with consumer deletion requests (DSARs), and provide immediate breach notification. If you do not have a pre-drafted, compliant DPA ready when closing an enterprise contract, procurement and legal departments will put your deal on hold.
Can we purchase a Vendor Risk & DPA Pack without doing a full 30-day sprint?
Yes. For businesses that already have basic internal policies but are facing an urgent client vendor review or need to audit third-party SaaS tools, we offer our Vendor Risk & DPA Pack as an unbundled, standalone service. We review your vendor ecosystem, identify risky data flows, and deliver 5 customized, binding Data Processing Agreements within 5 business days.
What happens if our company experiences a security incident or data leak?
Article 24 establishes a strict statutory requirement: controllers must report qualifying personal data breaches that compromise the privacy, rights, or security of individuals to the UAE Data Office immediately (typically within 72 hours of verification), as well as notifying affected individuals if the breach presents a high risk.
Every FyrahPrivacy sprint equips your leadership with a structured 72-Hour Security Incident Triage Runbook: defining what qualifies as a reportable incident, establishing an internal containment chain of command, and providing pre-drafted notification templates.
DPO Requirements & Legal Boundaries
Clarifying mandatory regulatory roles and our technical engineering scope.
Does our company legally need to appoint a Data Protection Officer (DPO)?
Under Article 10 of Decree-Law 45/2021, appointing a DPO is mandatory if your processing operations involve:
- High-risk technologies or systematic profiling that impacts consumer rights;
- Large-scale processing of sensitive personal data (e.g., biometric, genetic, health, or financial records);
- Regular and systematic monitoring of data subjects across digital networks.
The law explicitly permits appointing an external, fractional DPO. Our Fractional DPO-as-a-Service provides your company with a qualified, named regulatory officer without the overhead of a full-time executive hire.
Is FyrahPrivacy an onshore UAE law firm, and do you represent clients in court?
No. FyrahPrivacy is a specialized data privacy engineering and compliance consultancy firm, not a licensed UAE litigation law firm.
We build, draft, and configure technical and operational compliance artifacts: Article 7/8 RoPA inventories, vendor DPAs, bilingual website consent funnels, and incident playbooks. When contentious court litigation or judicial advocacy before local UAE courts is required, we collaborate alongside your licensed legal advocates to provide technical data evidence.
What does the Fractional DPO retainer actually cover every month?
Our Fractional DPO retainer provides continuous data protection governance:
- Designation of our senior architect as your named external DPO on public notices and UAE Data Office registers;
- A guaranteed 48-hour escalation SLA for investigating incoming customer Data Subject Access Requests (DSARs) or security incidents;
- Continuous review of incoming customer, vendor, and enterprise partner data processing schedules;
- Quarterly audit deltas to update your RoPA register as your engineering team ships new features or introduces new software vendors.
What if the UAE Data Office issues new executive regulations after our sprint finishes?
Because we build modular, standardized data registers aligned with international standards (ISO 27701 and CIPP frameworks), your core compliance architecture will easily absorb regulatory circulars. For clients on our Fractional DPO retainer, regulatory updates are incorporated into your documentation automatically at no extra fee. For one-time sprint clients, we provide discounted update audits whenever major executive decrees are gazetted.
